- Axion Non-Commercial Research and Responsible Use License
2
- Version 1.0
3
- Effective date: 10/15/2026
4
- Licensor: ByteDance Ltd.
5
- Copyright notice: Copyright (c) 2026 ByteDance. All rights reserved.

7
- 1. Definitions and Scope
8
-
9
- 1.1. "Agreement" means this Axion Non-Commercial Research and Responsible Use
10
- License, Version 1.0, including Schedule A (Acceptable Use and Safety Policy),
11
- which forms an integral and binding part of this Agreement.
12
- 1.2. "Licensor" means the ByteDance legal entity named above, acting only in
13
- respect of intellectual-property rights that it owns or is authorized to
14
- license.
15
- 1.3. "Covered Materials" means the following materials expressly identified by
16
- Licensor as released under this Agreement:
17
- (a) "Paper": research papers, manuscripts, technical reports, figures, tables,
18
- and supplementary materials associated with the Axion project, but only to the
19
- extent Licensor possesses the rights necessary to license them under this
20
- Agreement;
21
- (b) "Code": Axion source code, scripts, configurations, training and inference
22
- software, evaluation code, and associated documentation distributed by
23
- Licensor; and
24
- (c) "Models": Axion model architectures as embodied in distributed materials,
25
- model weights, checkpoints, tokenizers, and model-related files distributed by
26
- Licensor.
27
- "Covered Materials" does not include third-party libraries, datasets,
28
- pretrained components, third-party papers, or other materials identified as
29
- subject to separate terms. Merely referencing another work does not bring that
30
- work within this Agreement.
31
- 1.4. "Derivative Materials" means versions of Covered Materials that are
32
- modified, adapted, fine-tuned, quantized, pruned, merged, or otherwise
33
- transformed, and models distilled from the Models or developed using their
34
- outputs as training signals. This definition describes the contractual scope of
35
- permitted use; it does not imply that Licensor owns copyrights in independently
36
- protectable contributions or in content in which no such rights exist.
37
- 1.5. "Outputs" means text, images, code, data, actions, or other results
38
- produced through use of the Code or Models, including results produced when
39
- those systems use external tools.
40
- 1.6. "Non-Commercial Research Purposes" means independent academic research,
41
- education, personal learning, reproducibility studies, scientific evaluation,
42
- and responsible AI safety research that are not conducted for, directed toward,
43
- or intended to provide a direct or indirect commercial advantage or financial
44
- benefit to a business or other commercial undertaking.
45
- 1.7. "Commercial Use" means any use, exploitation, or distribution for a
46
- business purpose or direct or indirect commercial advantage, whether or not
47
- fees are charged or revenue is immediately generated. It includes, without
48
- limitation: use by or on behalf of a for-profit organization in its business or
49
- internal research; product development, commercialization, and market
50
- evaluation; use in paid or ad-supported products or services; API, hosted, or
51
- model-as-a-service offerings; customer or client work; commercial training,
52
- fine-tuning, or distillation; paid licensing or resale; and use under an
53
- arrangement designed to give a commercial sponsor exclusive or preferential
54
- business benefit.
55
- Ordinary personal activity by an individual employed by a business is not
56
- automatically Commercial Use if undertaken independently, without employer
57
- direction or resources, and without a commercial purpose. Using ordinary paid
58
- computing, storage, or repository-hosting services to carry out otherwise
59
- permitted non-commercial research does not, by itself, turn the Licensee's
60
- research into Commercial Use; however, this sentence grants no right to any
61
- service provider to independently exploit the Covered Materials commercially.
62
- 1.8. "You" or "Licensee" means the individual or entity exercising rights under
63
- this Agreement. If an individual acts on behalf of an entity, that entity must
64
- independently be eligible to accept and comply with this Agreement.
65
-
66
- 2. Acceptance and Conditions
67
-
68
- 2.1. By downloading, copying, modifying, distributing, or using any Covered
69
- Materials in circumstances requiring Licensor's permission, You accept this
70
- Agreement. If You do not agree, You must not exercise rights offered only under
71
- this Agreement.
72
- 2.2. The restrictions in Sections 3-6 and Schedule A are express conditions of
73
- the license grant, as well as obligations of Licensee to the extent enforceable
74
- under applicable law.
75
- 2.3. Nothing in this Agreement limits rights that cannot lawfully be
76
- restricted, including applicable copyright exceptions, fair use or fair
77
- dealing, and the right to refer to facts, ideas, or scientific findings not
78
- protected by copyright. No rights are granted to materials Licensor does not
79
- control.
80
-
81
- 3. Limited Non-Commercial License Grant
82
-
83
- 3.1. Subject to continuous compliance with this Agreement, Licensor grants You
84
- a worldwide, non-exclusive, non-transferable, royalty-free copyright license,
85
- for the term of the applicable copyright, solely for Non-Commercial Research
86
- Purposes, to:
87
- (a) access, read, reproduce, and study the Paper;
88
- (b) download, install, run, test, evaluate, reproduce, and modify the Code and
89
- Models;
90
- (c) create Derivative Materials for Non-Commercial Research Purposes; and
91
- (d) reproduce and redistribute the Covered Materials and permitted Derivative
92
- Materials in accordance with Section 5.
93
- 3.2. The grant extends only to rights held or licensable by Licensor. No
94
- sublicensing right is granted. Each downstream recipient must rely on its own
95
- permission under this Agreement.
96
- 3.3. No commercial license, patent license, trademark license, data license, or
97
- other right is granted by implication, estoppel, or otherwise. Any additional
98
- rights require separate express written authorization from the applicable
99
- rights holder.
100
-
101
- 4. Strict Prohibition of Commercial Use
102
-
103
- 4.1. Commercial Use of the Paper, Code, Models, or Derivative Materials is
104
- prohibited without Licensor's prior express written authorization. Attribution,
105
- publication of evaluation results, or making an offering available without
106
- charge does not by itself make a commercial activity permissible.
107
- 4.2. You must not use, deploy, incorporate, distribute, sell, license, or
108
- otherwise exploit any Covered Materials or Derivative Materials in or for any
109
- commercial product, service, research program, customer engagement, or business
110
- operation, including internal commercial research and evaluation.
111
- 4.3. As a separate undertaking by each Licensee using the Models or Code, You
112
- also agree not to commercially exploit Outputs, including by selling them,
113
- incorporating them into paid or commercial services, or using them to develop
114
- or improve commercially deployed models or systems, unless separately
115
- authorized in writing by Licensor. This contractual obligation does not assert
116
- that Licensor necessarily owns copyright in every Output or bind persons who
117
- have not accepted this Agreement.
118
- 4.4. Commercial reproduction, republication, adaptation, or distribution of the
119
- Paper as a protected work is not licensed. This provision does not purport to
120
- prohibit lawful citation, reporting of uncopyrightable facts, independent
121
- implementation of published ideas, or uses permitted by mandatory law.
122
- 4.5. Licensor may consider requests for commercial authorization at its sole
123
- discretion. No authorization is effective unless documented in a separate
124
- writing executed by an authorized Licensor representative.
125
-
126
- 5. Redistribution, Attribution, and Derivative Materials
127
-
128
- 5.1. For any permitted redistribution of Covered Materials or Derivative
129
- Materials, You must:
130
- (a) retain all applicable copyright, ownership, attribution, and disclaimer
131
- notices;
132
- (b) provide recipients with a complete copy of this Agreement, including
133
- Schedule A, and identify the applicable license version;
134
- (c) conspicuously identify any modifications You made, without implying that
135
- Licensor reviewed or endorsed them;
136
- (d) identify relevant Axion source repositories or publications, when
137
- reasonably practicable; and
138
- (e) ensure Your distribution is limited to Non-Commercial Research Purposes and
139
- does not purport to grant rights inconsistent with this Agreement.
140
- 5.2. To the extent Derivative Materials incorporate or are created through
141
- licensed use of Covered Materials or Outputs, You must not distribute them for
142
- Commercial Use, or represent that recipients may commercially use them by
143
- virtue of this Agreement. You may license Your own independent contributions
144
- separately only insofar as doing so does not expand rights in Covered Materials
145
- or relieve You of Your obligations hereunder.
146
- 5.3. If You publish research results obtained through use of the Code or
147
- Models, provide reasonable academic attribution to the Axion project and its
148
- applicable paper or repository. Non-commercial scholarly publication of
149
- independently written findings is permitted under this Agreement; any separate
150
- rights required to reproduce the Paper or other Covered Materials in commercial
151
- publications must be obtained from the appropriate rights holders.
152
- 5.4. You must not remove, conceal, or misrepresent Licensor's ownership notices
153
- or use ByteDance or Axion names, logos, or trademarks to suggest sponsorship or
154
- endorsement.
155
-
156
- 6. Mandatory Responsible-Use and Safety Conditions
157
-
158
- 6.1. You must comply with Schedule A: Acceptable Use and Safety Policy.
159
- Compliance with Schedule A is an express condition of all permissions under
160
- this Agreement.
161
- 6.2. You must not knowingly enable, facilitate, or authorize a third party to
162
- engage in conduct that would violate Schedule A if performed by You.
163
- Distribution of materials with the purpose of circumventing these conditions is
164
- prohibited.
165
- 6.3. Before making any Derivative Model, tool-enabled agent, or application
166
- available to others, You must conduct reasonable safety testing appropriate to
167
- its capabilities and foreseeable misuse, provide suitable human oversight and
168
- access controls, and clearly disclose significant known limitations relevant to
169
- safe use.
170
- 6.4. Legitimate safety evaluation, controlled red-teaming, and defensive
171
- research are permitted only where they are authorized, non-commercial,
172
- conducted with appropriate safeguards, and do not constitute the actual harmful
173
- conduct prohibited in Schedule A.
174
-
175
- 7. Intellectual Property and Third-Party Rights
176
-
177
- 7.1. All right, title, and interest in the original ByteDance-owned Code and
178
- Models remain with Licensor or the applicable ByteDance rights holder. No
179
- ownership transfers to Licensee under this Agreement.
180
- 7.2. Rights in the Paper depend on applicable author, employer, publisher, and
181
- third-party agreements. This Agreement applies to the Paper only to the extent
182
- expressly designated and validly licensed by the relevant rights holder. If a
183
- Paper is separately released under another binding license, this Agreement does
184
- not override that existing grant.
185
- 7.3. Nothing in this Agreement assigns to Licensor ownership of Licensee's
186
- independently protectable contributions or automatically assigns ownership of
187
- Outputs. Any limitations regarding Outputs or Derived Materials operate as
188
- contractual conditions on Licensee's use of Covered Materials to the extent
189
- permitted by law.
190
- 7.4. You are responsible for complying with licenses and rights affecting
191
- third-party components, datasets, dependencies, and external services. This
192
- Agreement does not grant rights to such materials.
193
-
194
- 8. Legal Compliance and Risk Allocation
195
-
196
- 8.1. You must comply with all applicable laws and regulations, including those
197
- relating to privacy, data protection, intellectual property, export controls,
198
- sanctions, security, consumer protection, and AI systems.
199
- 8.2. You are responsible for obtaining necessary permissions and consents for
200
- any data, prompts, tools, systems, and third-party materials used in connection
201
- with Covered Materials, and for protecting personal, confidential, and
202
- sensitive information.
203
- 8.3. Licensor has no obligation to provide maintenance, updates, support,
204
- hosted access, safety monitoring, or corrective action for any release.
205
-
206
- 9. Termination
207
-
208
- 9.1. Your rights under this Agreement terminate automatically upon Your breach
209
- of any license condition, including the prohibition on Commercial Use or any
210
- provision of Schedule A, subject to limitations imposed by applicable law.
211
- 9.2. Upon termination, You must immediately cease unlicensed access, use,
212
- modification, and distribution of the Covered Materials and related Derivative
213
- Materials and, within 30 days, delete or destroy copies in Your control, except
214
- to the extent retention is required by law. Any legally required retained
215
- copies must not be used or distributed except as permitted by law.
216
- 9.3. Termination does not eliminate liabilities arising before termination and
217
- does not terminate independent permissions validly granted by Licensor to
218
- compliant third parties. Sections 4.3 (as to Outputs created before
219
- termination), 7, 9, 10, 11, 12, and 13 survive to the extent legally
220
- applicable.
221
-
222
- 10. Disclaimer of Warranties
223
-
224
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COVERED MATERIALS ARE
225
- PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OR CONDITIONS OF ANY
226
- KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY,
227
- FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY,
228
- OR RELIABILITY. LICENSOR DOES NOT WARRANT THAT THE MATERIALS OR OUTPUTS ARE
229
- SAFE, ERROR-FREE, SUITABLE FOR HIGH-STAKES USE, OR COMPLIANT WITH ANY
230
- PARTICULAR LAW.
231
-
232
- 11. Limitation of Liability; Indemnity
233
-
234
- 11.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR AND ITS
235
- AFFILIATES, OFFICERS, EMPLOYEES, AND CONTRIBUTORS WILL NOT BE LIABLE FOR
236
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES,
237
- OR FOR LOST PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF THIS AGREEMENT
238
- OR USE OF COVERED MATERIALS, REGARDLESS OF THE THEORY OF LIABILITY.
239
- 11.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR'S AGGREGATE LIABILITY
240
- ARISING OUT OF OR RELATING TO THIS AGREEMENT WILL NOT EXCEED USD 100. Nothing
241
- in this Section excludes liability that cannot lawfully be excluded or limited.
242
- 11.3. To the extent permitted by applicable law, You agree to defend and
243
- indemnify Licensor and its affiliates against third-party claims and reasonable
244
- resulting costs arising from Your unlawful use, prohibited Commercial Use,
245
- violation of Schedule A, or breach of third-party rights in connection with the
246
- Covered Materials, except to the extent caused by Licensor's own unlawful
247
- conduct.
248
-
249
- 12. No Endorsement; No Patent Grant
250
-
251
- 12.1. No permission is granted to use ByteDance's or Axion's trademarks, logos,
252
- or names except for accurate attribution and identification as required by this
253
- Agreement or permitted by law.
254
- 12.2. No patent license or patent non-assertion commitment is granted under
255
- this Agreement. Any patent permission must be separately and expressly granted
256
- in writing by the appropriate rights holder.
257
-
258
- 13. General Terms
259
-
260
- 13.1. Governing law and forum: [INSERT GOVERNING LAW AND EXCLUSIVE OR
261
- NON-EXCLUSIVE FORUM AS APPROVED BY BYTEDANCE LEGAL].
262
- 13.2. If any provision is held unenforceable, it will be limited to the minimum
263
- extent necessary, and the remaining provisions will continue in effect where
264
- legally permissible.
265
- 13.3. This Agreement is the complete license offered for the specifically
266
- designated Covered Materials. Separate commercial licenses, third-party
267
- notices, and mandatory legal rights are not displaced by this Agreement.
268
- 13.4. Licensor may publish new license versions for future releases. A later
269
- version does not automatically replace the version attached to a prior release
270
- unless Licensee separately agrees or applicable law requires otherwise.
271
- 13.5. Headings are for convenience. The words "including" and "such as" are
272
- illustrative and not exhaustive.
273
-
274
-
275
- Schedule A - Acceptable Use and Safety Policy
276
-
277
- This Schedule A is part of the License, not an optional set of
278
- recommendations. You must not use or knowingly enable others to use Covered
279
- Materials, Derivative Materials, or tools and applications built with them for
280
- any of the following purposes:
281
-
282
- A1. Illegal acts and violations of rights. Committing, facilitating, planning,
283
- or materially assisting unlawful acts; violating intellectual-property,
284
- privacy, data-protection, confidentiality, or other applicable legal rights; or
285
- obtaining access to systems or information without authorization.
286
- A2. Violence and dangerous capabilities. Facilitating terrorism, violent
287
- extremism, violent crime, or serious physical harm; developing, acquiring, or
288
- deploying unlawful weapons; or materially enabling the design, acquisition, or
289
- misuse of chemical, biological, radiological, or nuclear weapons or other
290
- capabilities intended to cause mass harm.
291
- A3. Child exploitation and sexual abuse. Creating, distributing, soliciting, or
292
- facilitating child sexual abuse material, sexual exploitation or abuse of
293
- minors, human trafficking, non-consensual intimate imagery, or sexual violence.
294
- A4. Malicious cyber activity. Unauthorized intrusion, credential theft, malware
295
- deployment, destructive cyber operations, unauthorized surveillance of
296
- networks, exfiltration of information, or automation of such conduct.
297
- Authorized security testing in controlled environments is permitted under
298
- Section 6.4 only when it does not cause unauthorized harm.
299
- A5. Privacy-invasive identification or surveillance. Unlawful collection,
300
- disclosure, profiling, tracking, or identification of individuals;
301
- non-consensual biometric identification or sensitive-personal-data processing;
302
- or mass surveillance in violation of human rights or applicable law.
303
- A6. Fraud, deception, manipulation, and harassment. Scams, identity theft,
304
- deceptive impersonation, targeted intimidation, stalking, harassment, or
305
- deliberate misinformation that foreseeably creates significant real-world harm;
306
- or manipulation designed to undermine individuals' informed decision-making in
307
- consequential settings.
308
- A7. Discrimination and denial of rights. Unlawful discrimination, persecution,
309
- or targeting of persons based on protected or sensitive characteristics; or
310
- systems designed to deny rights or opportunities on an unlawful discriminatory
311
- basis.
312
- A8. Unsafe high-stakes decision-making. Using a Model as an unsupervised or
313
- final decision-maker in medical care, mental health crisis response, legal
314
- determinations, employment, housing, credit, insurance, education admissions,
315
- migration, policing, or other consequential decisions affecting individuals'
316
- rights, safety, or livelihood. Controlled, non-commercial research on such
317
- applications is allowed only without real-world consequential deployment and
318
- with appropriate ethical and legal safeguards.
319
- A9. Uncontrolled autonomous agents. Deploying agentic systems that autonomously
320
- access third-party services, execute transactions, alter external systems, or
321
- take consequential real-world actions without appropriate authorization, access
322
- scoping, monitoring, human oversight, and emergency-stop mechanisms
323
- proportionate to the risk.
324
- A10. Evasion or enabling prohibited uses. Intentionally bypassing safety
325
- mechanisms, access controls, license restrictions, or evaluations for the
326
- purpose of enabling a prohibited use; or distributing adaptations specifically
327
- intended to facilitate the prohibited activities above.
328
-
329
- Minimum Responsible-Use Requirements
330
-
331
- For every permitted use, You must, as appropriate to the foreseeable risks and
332
- capabilities involved:
333
-
334
- B1. Evaluate material safety, security, robustness, and misuse risks before
335
- releasing derivatives or applications.
336
- B2. Provide meaningful human oversight, authorization controls, rate limits,
337
- and technical safeguards when enabling tool use or external actions.
338
- B3. Respect data minimization, confidentiality, security, privacy, and
339
- applicable retention requirements.
340
- B4. Document known limitations and avoid representing experimental outputs as
341
- verified facts, professional advice, or safety guarantees.
342
- B5. Promptly investigate and mitigate significant safety or security incidents
343
- within Your control and comply with applicable incident-reporting laws.
344
- B6. Ensure recipients receive this Agreement, including Schedule A, when
345
- redistribution is permitted.
346
-
347
- Research exception clarification. This Schedule does not prohibit good-faith,
348
- non-commercial study of safety failures, model bias, harmful-content detection,
349
- or defensive security when conducted in authorized and appropriately contained
350
- settings. It does prohibit causing actual harm or deploying prohibited
351
- capabilities under the pretext of research.

+ exercising permissions granted by this License.
26
+

40
+
41
+ "Derivative Works" shall mean any work, whether in Source or Object
42
+ form, that is based on (or derived from) the Work and for which the

62
+
63
+ "Contributor" shall mean Licensor and any individual or Legal Entity
64
+ on behalf of whom a Contribution has been received by Licensor and
65
+ subsequently incorporated within the Work.
66
+
67
+ 2. Grant of Copyright License. Subject to the terms and conditions of
68
+ this License, each Contributor hereby grants to You a perpetual,
69
+ worldwide, non-exclusive, no-charge, royalty-free, irrevocable
70
+ copyright license to reproduce, prepare Derivative Works of,
71
+ publicly display, publicly perform, sublicense, and distribute the
72
+ Work and such Derivative Works in Source or Object form.
73
+
74
+ 3. Grant of Patent License. Subject to the terms and conditions of
75
+ this License, each Contributor hereby grants to You a perpetual,
76
+ worldwide, non-exclusive, no-charge, royalty-free, irrevocable
77
+ (except as stated in this section) patent license to make, have made,
78
+ use, offer to sell, sell, import, and otherwise transfer the Work,
79
+ where such license applies only to those patent claims licensable
80
+ by such Contributor that are necessarily infringed by their
81
+ Contribution(s) alone or by combination of their Contribution(s)
82
+ with the Work to which such Contribution(s) was submitted. If You
83
+ institute patent litigation against any entity (including a
84
+ cross-claim or counterclaim in a lawsuit) alleging that the Work
85
+ or a Contribution incorporated within the Work constitutes direct
86
+ or contributory patent infringement, then any patent licenses
87
+ granted to You under this License for that Work shall terminate
88
+ as of the date such litigation is filed.
89
+
90
+ 4. Redistribution. You may reproduce and distribute copies of the
91
+ Work or Derivative Works thereof in any medium, with or without
92
+ modifications, and in Source or Object form, provided that You
93
+ meet the following conditions:
94
+
95
+ (a) You must give any other recipients of the Work or
96
+ Derivative Works a copy of this License; and
97
+
98
+ (b) You must cause any modified files to carry prominent notices
99
+ stating that You changed the files; and
100
+
101
+ (c) You must retain, in the Source form of any Derivative Works
102
+ that You distribute, all copyright, patent, trademark, and
103
+ attribution notices from the Source form of the Work,
104
+ excluding those notices that do not pertain to any part of
105
+ the Derivative Works; and
106
+
107
+ (d) If the Work includes a "NOTICE" text file as part of its
108
+ distribution, then any Derivative Works that You distribute must
109
+ include a readable copy of the attribution notices contained
110
+ within such NOTICE file, excluding those notices that do not
111
+ pertain to any part of the Derivative Works, in at least one
112
+ of the following places: within a NOTICE text file distributed
113
+ as part of the Derivative Works; within the Source form or
114
+ documentation, if provided along with the Derivative Works; or,
115
+ within a display generated by the Derivative Works, if and
116
+ wherever such third-party notices normally appear. The contents
117
+ of the NOTICE file are for informational purposes only and
118
+ do not modify the License. You may add Your own attribution
119
+ notices within Derivative Works that You distribute, alongside
120
+ or as an addendum to the NOTICE text from the Work, provided
121
+ that such additional attribution notices cannot be construed
122
+ as modifying the License.
123
+
124
+ You may add Your own copyright statement to Your modifications and
125
+ may provide additional or different license terms and conditions
126
+ for use, reproduction, or distribution of Your modifications, or
127
+ for any such Derivative Works as a whole, provided Your use,
128
+ reproduction, and distribution of the Work otherwise complies with
129
+ the conditions stated in this License.
130
+
131
+ 5. Submission of Contributions. Unless You explicitly state otherwise,
132
+ any Contribution intentionally submitted for inclusion in the Work
133
+ by You to the Licensor shall be under the terms and conditions of
134
+ this License, without any additional terms or conditions.
135
+ Notwithstanding the above, nothing herein shall supersede or modify
136
+ the terms of any separate license agreement you may have executed
137
+ with Licensor regarding such Contributions.
138
+
139
+ 6. Trademarks. This License does not grant permission to use the trade
140
+ names, trademarks, service marks, or product names of the Licensor,
141
+ except as required for reasonable and customary use in describing the
142
+ origin of the Work and reproducing the content of the NOTICE file.
143
+
144
+ 7. Disclaimer of Warranty. Unless required by applicable law or
145
+ agreed to in writing, Licensor provides the Work (and each
146
+ Contributor provides its Contributions) on an "AS IS" BASIS,
147
+ WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or
148
+ implied, including, without limitation, any warranties or conditions
149
+ of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A
150
+ PARTICULAR PURPOSE. You are solely responsible for determining the
151
+ appropriateness of using or redistributing the Work and assume any
152
+ risks associated with Your exercise of permissions under this License.
153
+
154
+ 8. Limitation of Liability. In no event and under no legal theory,
155
+ whether in tort (including negligence), contract, or otherwise,
156
+ unless required by applicable law (such as deliberate and grossly
157
+ negligent acts) or agreed to in writing, shall any Contributor be
158
+ liable to You for damages, including any direct, indirect, special,
159
+ incidental, or consequential damages of any character arising as a
160
+ result of this License or out of the use or inability to use the
161
+ Work (including but not limited to damages for loss of goodwill,
162
+ work stoppage, computer failure or malfunction, or any and all
163
+ other commercial damages or losses), even if such Contributor
164
+ has been advised of the possibility of such damages.
165
+
166
+ 9. Accepting Warranty or Additional Liability. While redistributing
167
+ the Work or Derivative Works thereof, You may choose to offer,
168
+ and charge a fee for, acceptance of support, warranty, indemnity,
169
+ or other liability obligations and/or rights consistent with this
170
+ License. However, in accepting such obligations, You may act only
171
+ on Your own behalf and on Your sole responsibility, not on behalf
172
+ of any other Contributor, and only if You agree to indemnify,
173
+ defend, and hold each Contributor harmless for any liability
174
+ incurred by, or claims asserted against, such Contributor by reason
175
+ of your accepting any such warranty or additional liability.

+ APPENDIX: How to apply the Apache License to your work.
180
+
181
+ To apply the Apache License to your work, attach the following
182
+ boilerplate notice, with the fields enclosed by brackets "[]"
183
+ replaced with your own identifying information. (Don't include
184
+ the brackets!) The text should be enclosed in the appropriate
185
+ comment syntax for the file format. We also recommend that a
186
+ file or class name and description of purpose be included on the
187
+ same "printed page" as the copyright notice for easier
188
+ identification within third-party archives.
